What EU AI Act (EU) 2024/1689 - Article 22: Obligations of Authorised Representatives of Providers of High-Risk AI Systems requires
Article 22 requires non-EU providers of high-risk AI systems placed on the EU market to designate - by written mandate - an EU-established authorised representative before market placement. The authorised representative acts on behalf of the provider in all matters concerning AI Act compliance. The mandate must explicitly empower the representative to: (a) maintain a copy of the EU declaration of conformity and technical documentation for access by national competent authorities; (b) provide all information and documentation requested by competent authorities; (c) cooperate with competent authorities on corrective action; (d) register the provider in the EU AI Act database per Article 60. The authorised representative may be held liable alongside the provider for non-conformities and may terminate the mandate if the provider acts contrary to the AI Act.
